International Sanctions 2022
The Ministry of Legal Affairs Financial Sanctions Implementation Unit (FSIU) provides important and current information related to sanctions to assist you with Bermuda’s Sanctions Regime compliance.
Every effort is made to ensure that this information is current but in order to ensure compliance with the most up-to-date sanctions measures, you are encouraged to refer directly to the relevant UK legislation and Bermuda laws and to seek legal advice where necessary.
As a way of providing information about the international sanctions measures currently in force in Bermuda, the Bermuda Sanctions Regime List 2021references the relevant UK legislation that extend these measures to Bermuda, as well as the local legislation which give effect to them. The UK financial sanctions targets by regime, which lists all financial sanctions imposed in the UK by country, administration or terrorist group, can be found here. Further, the Foreign, Commonwealth and Development Office (FCDO) publishes the UK Sanctions list which includes designations under all sanctions categories in the UK.
The primary Bermuda law that gives effect to international sanctions is the International Sanctions Regulations 2013 which lists the UK legislation that are given force of law in Bermuda. These regulations are amended from time to time as new measures are extended to the British Overseas Territories and as existing ones are repealed.

28 December 2022The above Order has now been made and published and comes into force on 28 December 2022. The link to the newly launched regime page can be found here.
The Order extends, with modifications, the Haiti (Sanctions) Regulations 2022 (“the Haiti Regulations”), as amended from time to time. Persons responsible for, complicit in, or having engaged in, directly or indirectly, actions that threaten the peace, security or stability of Haiti are designated under this regime.
Designated persons are subject to financial sanctions and trade restrictions on military goods and military technology and associated services. Contravention or circumvention of any of the prohibitions in the Haiti Regulations is a criminal offence. The Haiti Regulations also confer powers on specified maritime enforcement officers to stop and search ships in international and foreign waters for the purpose of enforcing specified trade sanctions and to seize goods found on board ships which are being, or have been, dealt with in contravention, or deemed contravention, of those prohibitions.This regime comes into force designating 1 individual on the consolidated list.

The above Order has now been made and published and came into force on 15 December 2022.
The Russia sanctions regulations have recently been amended by the Russia (Sanctions) (EU Exit) (Amendment) (No. 15) Regulations 2022 and the Russia (Sanctions) (EU Exit) (Amendment) (No. 16) Regulations 2022 which made a number of changes, including:- creating new trade prohibitions relating to gold jewellery and to certain processed gold, together with related definitions, exceptions and consequential amendments;
- making provision concerning the prohibition of imports of liquefied natural gas and the export of Russia’s vulnerable goods (as defined in the amending regulations);
- creating new prohibitions concerning the supply and delivery by ship of certain oil and oil products and the provision of related ancillary services;
- creating exceptions from the new prohibitions and for Treasury licences allowing maritime transportation of oil and oil products to take place notwithstanding the new prohibitions; and
- allowing for the issue of monetary penalties for breaches of the new prohibitions.
- This Order makes the necessary amendments to the Principal Order to give effect in Bermuda to the changes made to the Russia sanctions regime by the amending regulations. The Russia Order extends, with modifications, the Russia Regulations, as those regulations are amended “from time to time”.

This Order makes amendments to the Russia (Sanctions) (Overseas Territories) Order 2020 (S.I. 2020/1571) (“the principal Order”).
The Russia sanctions regulations have been recently amended by the Russia (Sanctions) (EU Exit) (Amendment) (No. 8) Regulations 2022 (S.I. 2022/452) (“the amending regulations”). This Order makes the necessary amendments to the Principal Order to give effect in the relevant British overseas territories to the changes made to the Russia sanctions regime by the amending regulations. Under the International Sanctions Regulations 2013 the Russia Regulations are extended to Bermuda as those regulations are amended “from time to time”. Accordingly, no further action is required to implement these changes.

This instrument amends designation criteria under the Russia regime; an “involved person” incudes a person who is or has been involved in “obtaining a benefit from or supporting the Government of Russia”. Under the International Sanctions Regulations 2013 the Russia Regulations are extended to Bermuda as those regulations are amended “from time to time”. Accordingly, no further action is required to implement these changes.
